Delaware Superior Court stays proceedings in US Wind, Sussex County Council substation litigation

DOVER — In response to Delaware Superior Court’s order issued Monday afternoon, Sen. Stephanie Hansen issued the following statement:

“This is the result we wanted, marking a key step in our efforts to increase Delaware’s energy supply and ensure energy reliability for all ratepayers in our state. After Sussex County Council denied a permit US Wind needed to construct an electric substation for the Delaware-Maryland offshore wind project, it became clear the General Assembly had to step in to ensure the project could move forward. The order makes it clear that the General Assembly does indeed have the power to reverse a local body’s administrative decision.”

“At the time of the Council’s decision, US Wind had already secured all federal and state approvals it needed. The Council’s denial jeopardized a project that, if built, will introduce an additional 1700 MW of energy into our grid. We need to clear all state roadblocks to new, renewable energy generation, benefiting our state.   Delaware faces energy supply and energy demand challenges that have already resulted in burdensome rate increases for thousands of Delawareans.

“Our efforts to enact Senate Bill 159 and Senate Bill 199 into law were always about two things: protecting Delaware’s long-term energy reliability and affordability, and ensuring that critical energy infrastructure projects of statewide need are not derailed by the decision of one local government.”

“Thank you to the Delaware Superior Court for acting swiftly in this litigation and treating this process with the urgency it deserves.”
