Sen. Jack Walsh enacted new laws to crack down on companies that try to pay Delaware workers less than they are owed or avoid paying their fair share of state payroll taxes.

Passed with bipartisan support, Senate Bill 35 (S) empowered the Department of Labor and the Delaware Department of Justice to seek criminal charges against businesses owners that commit wage theft by failing to pay minimum wage or overtime, asking employees to work off the clock, failing to properly withhold state and federal taxes and attempting to pay workers “under the table.”

All civil penalties collected from violators of the new law can only be used for continued enforcement of wage payments and collections.
